Understanding Drawing Ownership and Drawing/Document issue for Construction

Occasionally we are asked by clients or contractors; “who owns the drawings and designs designers produce for a project”? For clarification of this issue, there are several good Government of Canada Resources that explain this in detail, but here in a nutshell is the short answer.

In Canada, design drawings and the related documents produced for a project by Architects, Engineers and Designers are called “Instruments of Service”. The content represented on said drawings remains solely the property of the respective designer, as do the actual drawings themselves (either electronic files or paper documents), regardless of who the drawings are produced for or who pays the fees for production of the drawings.

The rights to use the drawings is granted by the designer, typically primarily to the Client (end user) and the contractor and their sub trades for the purposes of pricing and ultimatly constructing the project. Unless there is a specific written agreement in place prior to the production of any design drawings, the designer also retains the right to distribute the drawings to whom ever they deem necessary in order to either keep a project moving forward or complete a project on behalf of the client. It is the designer’s responsibility, however, to the client (end user) to make drawings as accessible as possible to all parties in order to keep a project on track for time lines to completion.
