Legal Basis: Section 172 and Section 216 of Republic Act No. 8293 (The Intellectual Property Code of the Philippines).
Core Violation: Your original handmade crafts and artistic designs are automatically protected by copyright law from the exact moment you create them. Buying a physical item does not grant the buyer the intellectual property rights to it. Falsely claiming ownership of your work, reproducing your design for a commercial business without your permission, and violating your moral right of attribution constitute direct copyright infringement.
Cyber-Copyright Infringement
Legal Basis: Section 4(c)(4) and Section 6 of Republic Act No. 10175 (The Cybercrime Prevention Act of 2012).
Core Violation: Because the copyright infringement, plagiarism, and unauthorized commercial use of your creative work were executed online through a digital storefront/social media profile to deceive the public, the offense constitutes a cybercrime. Under the law, committing an intellectual property violation by or through information and communications technologies (ICT) increases the standard legal penalties by one degree.
